In the case of a divorce, the vested benefits (leaving benefits) accrued during the marriage are divided. The termination of a registered partnership is equivalent to a divorce. If the insured person who is drawing benefits is already retired, the retirement pension is divided.

Division of pension rights

Active and disabled insureds whose pension assets were reduced owing to divorce or the termination of a registered partnership can increase their pension assets again at any time by means of personal buy-ins. Retired insureds may not increase again a reduced retirement pension owing to divorce or the termination of a registered partnership by means of personal buy-ins.

The Pension Fund shall only enforce legally binding divorce decrees and decrees on the termination of registered partnerships promulgated by Swiss courts. It shall always provide the statutory minimum benefits according to FSOPP and FSFTOPP. The initiation of divorce proceedings or the termination procedure shall serve as the reference date for the calculation of entitlements. Foreign divorce decrees are not enforced by the Pension Fund.

The termination of a registered partnership by a court is treated in the same way as a divorce.
